I sell photography services, Soul Portrait drawings, works of art and products, as well as artistic design services. The business ID of the company is 1943569-6.
The company is committed to protecting the privacy of its customers in accordance with this privacy policy, and to complying with the Finnish Consumer Protection Act.
The Finnish version of these terms and of the privacy policy is the one that applies. Versions in other languages have been translated with the help of a language model, so they may differ from the Finnish version.
Terms of service — definitions
I offer both personal services and works of art and products. Personal services include photography sessions, artistic design services and commissioned work agreed separately with the customer. Works and products include Soul Portrait drawings, paintings, photographic works, prints, wallpapers and sculptures.
Services are generally provided at my studio in Tampere, or at another location by agreement. Some services, such as consultations for design work, can also be arranged remotely.
Placing an order
Photography sessions and other personal services can be booked through the website of the company, by telephone, by email or through another messaging service used by the company. A booking confirmation is sent to the customer by email, by text message or as a message in the service the customer used when making contact. Receiving the confirmation may take up to 24 hours.
Works, commissions and products are ordered through the same channels. For commissioned work, such as Soul Portrait drawings and works made to order, the content, size, schedule and price are agreed before the work begins. An order becomes binding on both parties once the company has confirmed it.
Prices and payment terms
The prices of services and works are shown on the tyrniluoto.fi website. Any discounts or offers are announced separately. If a different price appears on another website, the price shown on tyrniluoto.fi applies.
Prices include value added tax at the applicable rate. Payment is made in connection with the service on site, in advance as an online payment, or by invoice, unless otherwise stated or agreed. For commissioned work, an advance payment covering materials and the start of the work may be agreed.
Any packaging and postage costs are added to the prices of works and photographic products. Travel costs for locations other than the studio are agreed separately before the session.
Rescheduling and cancellation
A photography session or other agreed appointment must be rescheduled or cancelled at least 48 hours before the booked time. If an appointment is cancelled less than 48 hours before the booked time without a compelling reason, the company charges 50 % of the normal price of the service as well as any invoicing costs.
Rescheduling free of charge can be negotiated, and the company aims to take the interests of the customer into account. If the customer does not arrive and has not cancelled the appointment, the full price of the service is charged, together with any invoicing costs.
The price of a personal service consists of a booking fee, so a confirmed appointment cannot be cancelled by invoking the 14-day right of withdrawal.
If the company has to cancel an agreed appointment, the customer is contacted without delay. Any advance payments are then refunded in full, or another time is agreed instead. A refund can only be paid through the same payment method the customer used.
Delivery of works and products
The schedule for selecting, editing and delivering the images is agreed when the order is placed. Finished images are delivered digitally through a file transfer service. A time limit for downloading them is given when they are delivered.
Physical works and products are sent by post or can be collected by agreement. The delivery time is stated in the order confirmation. Commissioned work may be delayed because of the nature of the work, and the customer is informed of any delay as soon as it is known.
The risk of damage lies with the company until the work has been handed over to the customer.
Right of withdrawal and returns
Ready-made products ordered by distance selling carry a 14-day right of withdrawal, which begins when the product is received.
The right of withdrawal does not cover products made according to the wishes of the customer or products that are clearly personal. These include Soul Portrait drawings, commissioned works and products made from photographs of the customer.
For digitally delivered content such as image files, the right of withdrawal ends once delivery has begun with the consent of the customer.
Withdrawal is announced by email to info@tyrniluoto.fi. A returned product must be in its original condition. The customer is responsible for any return costs. A refund is paid through the same payment method the customer used.
Faults and complaints
If a work or product is faulty or has been damaged in transit, the customer must report this within a reasonable time, and no later than 14 days from receiving the product. Please attach a photograph of the damage to the report.
A faulty product is repaired, replaced or refunded. For returns and complaints, please use the contact details given on the contact page.
Copyright
The copyright in works and photographs always remains with the artist, even when a work or image file is sold to the customer. The customer receives the right to use the work and the images privately: images may be published on the personal social media channels of the customer and printed for personal use.
Commercial use of images and works, such as advertising, resale or use in the marketing of another business, requires a separate written agreement.
Photographs may not be edited in a way that changes the character of the work. Please credit the artist alongside the image whenever the form of publication allows it.
Use of images in marketing
Images created during a session may be used in the portfolio, on the website, in exhibitions and on the social media channels of the company, unless the customer objects.
Identifiable nude images and other material that is sensitive in nature are published only when the customer has given separate permission for it.
The customer may forbid the use of their images at any time, including after the session. The notice can be given informally by email or by telephone. After that, the images are no longer used in new marketing, and images already published are removed from the channels of the company within 14 days at the latest. Forbidding the use is free of charge and does not affect the price of the service.
The right to forbid the use of images does not apply to sessions carried out for the customer free of charge on the condition that the images may be used in the portfolio and marketing of the company. Such an arrangement is agreed in writing before the session, and the agreement binds both parties also after the session.
The company cannot remove images that others have shared onward on their own channels, nor can it affect the caches of search engines. Printed publications, exhibition prints and other works already produced cannot be withdrawn.
The publication of images is discussed during the session. The customer may also limit permission to cover only some of the images.
Age limit for photography
Photography services are intended for adults. Customers must prove their age on request.
Limitation of liability
The company is not liable for damages caused by factors outside the service or by the actions of the customer. The company is likewise not liable for reactions arising from the state of health of the customer during or after the service.
Soul Portrait drawings are works of art. They are not a health care service, treatment or fortune telling, and they do not replace an assessment by a health care professional.
The liability of the company is limited to the price paid for the service or work in question. This does not limit the rights that belong to a consumer under the Finnish Consumer Protection Act.
Data protection
The company handles customer data confidentially and in compliance with data protection legislation in force. Customer data is used only for orders, for communication and, with the consent of the customer, for marketing. Detailed information about the processing of data is given in the privacy policy further down this page.
Resolution of disputes
Any disagreements are primarily resolved through negotiation. If no agreement is reached, a consumer customer may bring the matter before the Finnish Consumer Disputes Board. Before doing so, the customer should contact the Consumer Advisory Services.
As a last resort, disputes are settled in the district court of the municipality where the company is located.
Changes to the terms
The company reserves the right to change these terms. Changes are announced on the website of the company and by email to customers if the change affects orders or bookings already made. If a change affects the order of a customer, the customer has the right to cancel it free of charge.

Purpose of processing
We process personal data in order to provide our services, to handle orders and bookings, to deliver works, for invoicing and bookkeeping, and to communicate with customers. Contact details may also be used for marketing if the customer has given permission for this.
Legal basis for processing
Personal data is processed on the basis of the performance of a contract, a legal obligation, legitimate interest or the consent of the customer.
Types of data collected
We collect the following customer data: name, telephone number, email address, postal address, and information concerning the order, delivery and invoicing. We also record further details arising during the customer relationship, which are used to serve the customer better. Data is collected only to the extent necessary for providing the services.
Images created in the photography service are personal data, and some of them may be sensitive in nature. The company recognises the need to protect such data with particular care, so images are stored separately from other customer data and kept protected. Images are not linked to other data about the customer beyond what handling the order requires.
Sources of data
Personal data is obtained from the customer when the service is used, when an order or booking is made, through our website, or in another way with the consent of the customer.
Storage and disclosure of data
The company uses the iCloud service of Apple to store data. Apple is committed to maintaining strong data protection practices. Data is also kept on the computer and backup drives of the company, and in the email service through which customer communication is handled.
A file transfer service is used to deliver finished images. Images are removed from that service once the customer has collected them.
Transferring personal data to a third country outside the European Union and the European Economic Area is avoided. This is not always possible when cloud services are used, but any transfers comply with the requirements of EU data protection legislation.
Customer data is not sold or disclosed to outside parties for marketing purposes. Data is disclosed for bookkeeping and taxation to the extent required by law. Customer data may also be disclosed to a third party if the business of the private trader is transferred to another company. The customer is informed of any such transfer well in advance and has the right to request that their data be deleted.
Cookies
The website does not use tracking or marketing cookies, and there is no visitor analytics. The chosen language may be stored in the browser so that the site opens in the same language on the next visit. This is functional information and is not used to identify the visitor.
Protection of data
The company uses technical measures to protect personal data against unauthorised access, disclosure, deletion or other processing. Devices are protected with a password, and two-factor authentication is used whenever it is available.
Retention period
We retain data for as long as it is necessary for providing the services of the company or for complying with statutory, tax and accounting requirements.
Photographs are kept in the archive unless the customer asks for them to be deleted. The customer may request the deletion of their images at any time, and the request is carried out without undue delay, within 30 days at the latest. Images disappear from backups as part of the normal backup rotation.
Deletion does not cover images made in a free session in exchange for the right to use them in the portfolio and marketing of the company. The company may also retain images where this is necessary for bookkeeping or for the establishment or defence of a legal claim.
Rights of the customer
The customer has the right to request access to data concerning them, to request the rectification or deletion of their data, to restrict or object to the processing of their data, and to request the transfer of their data. Where processing is based on consent, the customer has the right to withdraw that consent at any time.
Requests are made by email to info@tyrniluoto.fi. The company may charge a reasonable fee for these measures if the requests are clearly unfounded or excessive, in particular because of their repetitive nature.
Changes to the privacy policy
The company reserves the right to update this privacy policy from time to time, for example when legislation changes. Changes take effect once the updated privacy policy has been published. If the changes are significant, we notify personally those customers whose order or booking is in progress.
Supervision of data protection
The customer has the right to lodge a complaint about the processing of personal data with the supervisory authority, the Office of the Data Protection Ombudsman. On its own initiative or at the request of the customer, the company undertakes to correct, delete or complete any personal data in the register that is incorrect, unnecessary, incomplete or outdated for the purpose of processing.
